Drug giant Abbott (NYSE: ABT), based in Abbott Park, Ill., says in the suit that the generic Impax drug infringes its patents. Hayward-based Impax (OTCBB: IPXL) has submitted an application to the Food and Drug Administration for generic 250 mg and 500 mg tablets of Depakote ER.
Abbott sells the drug as a treatment for epilepsy and bipolar disorders.
Impax, led by CEO Larry Hsu, said the company's generic formulation doesn't infringe Abbott's patent and said it will fight the suit.
